The company behind market-leading sparkling perry Lambrini has failed to stop Lambrella registering its name as a trademark for a rival perry.
Halewood International, which owns the trademark names Lambrini and Lambrucini for sparkling perry, argued it had built a substantial reputation in the name Lambrini since launch in 1994, and consumers might think the two products were the same. However, Jersey-based Incorporated Beverages said it began using the Lambrella name in 1998, and there had been no known instance of confusion between the rival products.
Ann Corbett for the Trademarks Registrar said that when the names were taken as a whole she did not see any likelihood of visual confusion.
