Northern Foods has failed in its bid to stop Defra from applying for protected name status for the Melton Mowbray Pork Pie from the European Union.
Last month the High Court ruled that Defra should be allowed to apply to the EU for the status, but Northern Foods, which produces the Melton Mowbray Pork Pie at sites in Trowbridge, Wiltshire and Market Drayton in Shropshire, vowed to appeal against its decision.
However, the Court of Appeal yesterday ruled that Northern Foods would not be able to appeal against the ruling.
If Defra’s application for protected name status is successful, only pork pies produced in or around Melton Mowbray will be able to be called a Melton Mowbray Pork Pie.
Matthew Talbot, a solicitor acting on behalf of the Melton Mowbray Pork Pie Association, said: "The latest decision just goes to prove that all of the opposition from Northern Foods to the application was always going to fail."
He added: "The decision to disallow an appeal should offer encouragement to other food producers to protect their foods."
